Welcome to RocketCoach. These Terms of Service (“Terms”) govern your access to and use of the RocketCoach website, applications, and services (collectively, the “Service”) operated by RocketCoach (“we,” “us,” or “our”).

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

RocketCoach is an AI-powered practice platform designed for coaches and helping professionals. The Service provides simulated coaching conversations using artificial intelligence to help users practice and improve their coaching skills.

Important Disclaimer: RocketCoach is a training and practice tool only. It is not a substitute for professional coaching education, certification, supervision, or real client work. The AI simulations are for educational purposes and do not constitute professional advice.

3. User Accounts

To access certain features of the Service, you must create an account. When you create an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe on the rights of others
Upload or transmit viruses, malware, or other harmful code
Attempt to gain unauthorized access to our systems

5. Subscription and Payments

Free Plan: We offer a limited free plan with restricted access to features.

Paid Subscriptions: Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.

Refunds: Subscription fees are generally non-refundable except as required by law or as specifically stated in our refund policy. We may, at our discretion, provide refunds or credits on a case-by-case basis.

Price Changes: We reserve the right to change our prices. Any price changes will take effect at the start of your next billing cycle, and we will provide advance notice of any changes.

6. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of RocketCoach. The Service is protected by copyright, trademark, and other laws.

You retain ownership of any content you create using the Service (such as session notes). However, by using the Service, you grant us a license to use aggregated, anonymized data to improve our AI and Service.

7. AI-Generated Content Disclaimer

The responses provided by our AI simulations are generated by artificial intelligence and are intended for practice and educational purposes only.

AI responses may not always be accurate, appropriate, or relevant
AI simulations do not replace professional training, supervision, or certification
Feedback and analysis provided by the AI are for learning purposes and should not be relied upon as professional assessment
You should not use AI-generated content as a basis for decisions with real clients

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROCKETCOACH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content
Any decisions or actions taken based on AI-generated content or feedback

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ROCKETCOACH EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Indemnification

You agree to defend, indemnify, and hold harmless RocketCoach and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
